Terms of Service

AGREEMENT

By booking a photography session with Marta Timmer Photography, you agree to the following terms and conditions. Please read carefully before confirming your reservation.

BOOKING AND PAYMENT

Deposits

A non-refundable deposit of 50% is required to secure your session date. The remaining balance is due 3 days prior to your scheduled session for portrait, family, and engagement sessions. A non-refundable retainer is required to book a wedding photography package and secure your date. The remaining balance is due 14 days prior to the wedding.

Payment Methods

We accept payment by e-transfer (info@martatimmerphoto.com), or credit card via our online payment system, or cash in person in case of small amounts. All payments must be received by the due dates specified to confirm your booking.

The deposit may be paid via the online booking system for engagements, portraits, and family sessions, or via special payment instructions sent to you when your booking is accepted for the wedding packages.

If you are paying by e-transfer, please email us at info@martatimmerphoto.com, so we can manually schedule your session.

Cancellation Policy

Deposits are non-refundable. If you need to reschedule your session, please provide at least 48 hours notice for portrait family, and engagement sessions. One reschedule is permitted without additional fees; subsequent rescheduling may incur a $50 administrative fee.

Rescheduling your wedding package is subject to availability.

PHOTOGRAPHY SESSIONS

Session Duration

Session times are approximate and may vary based on circumstances, cooperation of subjects, and environmental factors. Wedding coverage times are as specified in your chosen package.

Location

For outdoor sessions, the client is responsible for obtaining any necessary permits or permissions for the chosen location. Indoor sessions at private residences require adequate space and natural light.

Weather Contingency

For outdoor sessions, if weather conditions are unsuitable, we will work together to reschedule at a mutually agreeable time at no additional charge.

Cooperation

A professional and cooperative attitude is expected from all parties during the session. Marta Timmer Photography reserves the right to terminate a session without refund if clients or guests behave in a threatening, inappropriate, or uncooperative manner.

IMAGE DELIVERY AND EDITING

Delivery Timeline

Edited images will be delivered within 2-3 weeks for portrait, family, and engagement sessions, and within 4-6 weeks for wedding photography.

Image Selection

The photographer will select and edit the best images from your session at their professional discretion. The number of final edited images is specified in each service package.

Editing Style

All images are edited in the photographer's signature style. Minor adjustments such as exposure, colour correction, and basic retouching are included. Extensive retouching requests may incur additional fees.

Digital Files

Images are delivered in high-resolution digital format suitable for both print and web use via a download link. It is the client's responsibility to download and back up their images. Galleries are available for 90 days from delivery.

USAGE RIGHTS AND COPYRIGHT

Marta Timmer Photography retains full copyright ownership of all images created during your session. Clients receive a personal use license as outlined below.

Client Usage License

Clients are granted unlimited personal use rights to print, share, and display images for non-commercial purposes. This includes personal social media sharing, printing for home display, and sharing with family and friends. Please refrain from cropping the images for social media if possible.

Photographer Usage Rights

Marta Timmer Photography reserves the right to use images from your session for portfolio display, website content, social media marketing, promotional materials, and photography competitions. If you wish to restrict this usage, please notify us in writing at the time of booking.

Commercial Use

Images may not be used for any commercial purpose, resold, or used in advertising without express written permission and appropriate licensing fees.

Credit

When sharing images on social media or public platforms, clients are encouraged to credit Marta Timmer Photography, though this is not required when space not available.

Print Release

Clients are provided with a print release allowing them to print images through any professional or consumer printing service for personal use.

LIABILITY

Equipment Failure

While every effort is made to provide backup equipment, Marta Timmer Photography is not liable for missed photographs due to equipment failure, technical malfunctions, or circumstances beyond reasonable control.

Missed Moments

The photographer cannot guarantee that every specific moment will be captured, particularly during weddings or events with unpredictable timing.

Third Party Interference

Marta Timmer Photography is not responsible for missed photographs due to interference from guests, family members, or other vendors present during your session or event.

Personal Property

Marta Timmer Photography is not responsible for damage to or loss of personal property during sessions.

MODEL RELEASE

By booking a session, clients grant permission for themselves and any minors under their guardianship to be photographed and agree to the usage rights outlined in this agreement.

FORCE MAJEURE

Marta Timmer Photography is not liable for failure to perform services due to circumstances beyond reasonable control, including but not limited to: acts of God, illness, emergency, accident, or travel disruption. In such cases, every effort will be made to secure a replacement photographer or reschedule the session.

DISPUTES AND GOVERNING LAW

These terms are governed by the laws of Alberta, Canada. Any disputes will be resolved through mediation, and if necessary, in the courts of Alberta.

MODIFICATIONS

Marta Timmer Photography reserves the right to update these terms at any time. Clients will be notified of significant changes, and continued use of services constitutes acceptance of modified terms.
